摘要
缺陷产品对消费者造成损害 ,生产者和销售者必须承担严格的民事责任。新修订的《产品质量法》充分地保护消费者合法权益 ,扩大了产品责任义务主体范围 ,但是 ,在产品责任归责原则仍存在不足 ,特别是没有规定精神损害赔偿 ,与发达国家产品责任立法仍存在差距 ,不利于保护消费者的合法权益 ,亦不利于有效地遏制生产者、销售者的恶意和不负责任行为 ,最终影响生产力的发展。
Defective products cause damage to consumers, so producers and sellers must take strict civil responsibilities. Although the newly revised Regulations on Product's Quality fully protects the legal right of consumers, and enlarges the major range of product's responsibilities, these regulations still have shortcomings in the principle of who should take the responsibilities, especially in the stipulation of mental damage compensation. Compared with the establishment of the law of product's obligations in developed countries, there is a distance to go. So it is disadvantageous in the protection of consumers' legal rights, in the choking of producers and sellers' evil intention and irresponsible act, which ultimately influences the development of productivity.
