中美反恐立法比较研究

Comparison of China-America Anti-terrorism Legislation

9·11事件'后,美国加快国内反恐立法,制定了一系列反恐法案,同时参与国际反恐公约,建立完整的反恐立法体系。同时期,我国在立法层面上,制定了《反恐怖主义法》等多部法律,多次修正《刑法》,并积极加入反恐公约。通过对比中美反恐立法的差异,本文提出通过加强国内反恐立法、完善现有立法内容、平衡国家安全利益与个人权利等途径,构建我国反恐立法体系。

United States speeds up domestic anti-terrorism legislation,formulating a series of antiterrorism act and participates in the international counter-terrorism convention,establishing a complete system of anti-terrorism legislation.In the same period,on the legislative level,China enacts Counter-terrorism Law and other laws,repeatedly amended Criminal Law,and actively joins counter-terrorism convention.Comparing the differences between China-America anti-terrorism legislation,this paper fry to put forward to strengthen domestic anti-terrorism legislation,perfects the existing legislation content,balances national security interests and personal rights,and structure completes China’s anti-terrorism legislation system.
