International Rule of Law and Global Governance: Analysis on the Legal Environment in which China Rises

随着新兴市场国家的崛起、发达国家力量的相对衰弱,以及大国之间的不断竞争,国际秩序格局进入了一个新的发展阶段。全球治理概念也重新登上历史舞台,其理念主要体现为'和平性'和'规则化'。国际法已成为参与和引领全球治理越来越重要的抓手;国际法治亦构成全球治理的重要理念、原则和战略。中国自恢复联合国席位以来,借助联合国这个广阔的平台,一方面积极维护国际法治、遵守国际法规则,另一方面与众多发展中国家一道通过积极作为改变现有不合理的国际秩序。作为一个世界性大国,中国参与国际法治与全球治理仍有不足,但中国有理由也有能力为推进国际法治与全球治理作出应有的贡献。

With the rise of emerging market countries, the relative weakness of developed countries,as well as the constant competition between major countries, the international order pattern has entered a new stage of development. The concept of global governance, which is mainly embodied in "peace" and "regularization",is also re-boarding the stage of history.This means that international law has become an increasingly important starting point for participation and leadership in global governance; international rule of law also constitutes an important concept, principles and strategy for global governance. Whether a country can make full use of existing rules and effectively guide the development of future rules is the key to determining its ability to secure and solidify long-term institutional rights within the framework of global governance. Since the resumption of the United Nations seat, China has actively adopted the broad platform of the United Nations and, on the one hand, actively upheld the international rule of law,abided by the rules of international law and,on the other, worked with many developing countries to actively change the existing irrational international order. But as a world power, China’s participation in international rule of law and global governance is still inadequate. China shall make due contributions to international rule of law and global governance.
