摘要
任何社会都需要权威 ,法律的内外品性决定了现代社会需要树立的是法律的权威。要树立法律的权威 ,必须确定法律的二元划分 ,确定程序法治的地位 ,确定司法组织必要的独立性 ,并且不能误用法治的功效 ,要正确看待法律的局限性 。
Any society needs authority.The internal and external natures of laws determine that the modern society needs the authority of laws.In order to establish the authority of laws,one must classify the two elements of laws,determine the status of legal procedures and the independence of judicial system.One should also correctly understand the limitation of laws,weaken any individual'authority so as to avoid the abuse of power.
