网上证券交易中的风险包括一般意义上的风险和基于网上证券交易的特殊性而表现出的特殊风险。根据所形成的法律关系不同，这些风险可以赋予合同关系、侵权关系或不可抗力等法律属性。与此相应，在责任归属上应该明确责任构成要件、责任承担主体及责任范围等三大内容。实践中还得注意存在的法律空白、执行难等特殊问题。

Risks of on-line securities bargaining include common risks and special risks based on its specialties.Because of their different connections with law,these risks have different legal attributes,such as the attributes of contract,tort,force majeure,etc.Hence,in the ascription of responsibility,it should be made clear that what elements constitute the responsibility,who should take the responsibility and what responsibility the concerned party should take.In practice,there are some other issues that shouldn't be neglected.
