警察在公务活动中除了可以依法向暴力犯罪嫌疑人开枪外,在必要时还可能向动物、无生命物体开枪或为发出警报、求救信号而开枪,这些属于警察开枪的特殊情形。我国内地的立法对此没有明确规定,可以借鉴香港和国外的经验,明确规定警察特殊情形下开枪的条件,以全面保障和规制警察的开枪权。

As we know , the police have the right to shoot offenders when in duty .Meanwhile , under special circumstances , they can also discharge firearms at animals and inanimate objects ,or just for sending alarm and sig-nals.However, since in China mainland, there are no hard rules as to what the special circumstances are , all we have to do is to learn from Hongkong and foreign countries .Only when the law define clearly the special circum-stances about shooting by the police , can the right be comprehensively safeguarded and regulated .
