由于存在的根源尚未消失和其本身所具有的超强稳定性,传统人情化思维仍然在影响,甚至支配着广大民众的心理和行为。它既包含着对现代法治建设有益的历史智慧,又存在着对现代法治建设有碍的因素。我们必须全面地、正确地估量中国传统人情化思维,一方面发掘、利用传统思维方式中有益于现代法治建设的成分,另一方面改造或消除对现代法治建设有不利影响的因素,逐步培育出适应现代法治建设需要的新的思维方式和智慧。

Because of superstrong stability and the existing origin that has not disappeared yet,traditional humanely mode of thinking influence,even arrange psychology and behavior of the masses still.It not only contains historical intelligence that is beneficial to construction of modern society governed by law,but also includes factors that will hinder construction of modern society governed by law.We must appraise correctly traditional humanely mode of thinking in an all-round way.On one hand,to explore and utilize elements that are helpful to construction of modern society governed by law of traditional mode of thinking.On the other hand,to transform or dispel factors that will bring adverse effect to construction of modern society governed by law,and to cultivate new mode of thinking and intelligence progressively that adapt to the need of construction of modern society governed by law.
