判例法是当今世界最具影响力的法律形式之一,自12世纪在英国产生以来,经过漫长岁月的洗礼,至今仍充满了生机与活力。美国的判例法制度是建立在英国殖民统治基础上的,特别是美国独立以后,对判例法制度有了较大的发展。今天美国所运行的判例法,已和传统英国判例法有了很大的区别。本文旨在从美国判例法的产生、发展、运行基础、运行机制等动态角度揭示美国判例法的运行。

Case law is one of the influential law systems in contemporary world.It still vigorous after established in Britain on the 12th century. American case law is established on the bases of colonial regime of Britain. It has great development since the independence of America.Case law of America today has great distinction to the traditional British case law.This article is aim to narrate the operation of American case law from the dynamic aspects of its establishment,development,operation foundation and the operation mechanism.
