"业"的观念、规则包含"管业"、"守业"等内容,它是中国本土财产权观念与规则的重要成分。"业"在主体方面具有多元性、群体性,在内容方面具有开放性、综合性以及宗法伦理属性。以近代汉口码头纠纷为例,"业"的观念与规则在纠纷解决过程中具有基础性的作用。
The"yeh",a concept of local property rights,contains the meaning of"Guan-yeh","Shou-yeh"etc.The concept has a property of diversity and colony in the main.At the contents,it has a property of openess, comprehension and patriarchal ethics.In the conflicts of Hankou Wharf,the concept of"yeh"plays a basic role in the process of resolving disputes.
