浅析涉及商业方法专利申请的审查

Analysis of Examination Standard of Patent Applications Involving Business Methods

随着国家对数字经济的创新鼓励,专利审查指南对涉及商业方法的审查原则进行了适应性修改。通过横向比较中、美、欧、日对涉及商业方法审查策略的变迁,分析和借鉴涉及商业方法常用的审查思路,结合具体的案例,分析国内外涉及商业方法专利申请的特点,指出中国此类专利申请存在的问题,以期引导涉及电子商务的专利申请质量的提升。

As the innovation encouragement policy for digital economy in our country,SIPO had modified the examining rules for commercial methods. This paper analyzes the transition of examining rules of different countries in this field,and finds out the better rules for this kind of applications. By comparing the differences of domestic and foreign applications,we find out the problems of domestic applications to guide the improvement for commercial methods especially related to e-commercial.
