Insight and Application About the Lack of Essential Technical Features

本文对专利法实施细则第20条第2款进行了分析,结合实际案例的应用,提出在合理质疑范围内,如何适用专利法实施细则第20条第2款的规定;另外,在申请文件的独立权利要求同时存在不清楚、得不到说明书支持和缺少必要技术特征的缺陷时,根据具体案情,指出缺少必要技术特征的缺陷能有效提高审查效率。

The lack of essential technical features is concerned in this paper. Based on the actual cases,it proposes how to use the article within the scope of reasonable question. In addition,when the independent claim of the application documents is unclear and lacks of support and lacks of essential technical features at the same time,according to the specific case,it may effectively improve the efficiency to point out the lack of essential technical features.
