摘要
法律实效指谓法律的实际功效或效果,法律效力指称的是法律的国家强制作用力,法律实施蕴涵法律在社会生活中的贯彻过程,而法律实现诠释的则是法律的目的、要求、功能和价值的实现。法律实效是法律效力的条件,法律效力是法律实效的源泉。法律实效着眼于状态,法律实施偏重于运行的过程。法律实效表征的是"点",法律实施囊括的是"段",而法律实现则是"段"和"点"的有机结合和统一。
Legal efficacy indicates the actual legal effects or the substantial legal results ,and legal effect denotes the national legal cocrcive force,and legal enforcement refers to the legal implementing process in the realization of the law,while legal realization explicates the realization of the aim,the demand,the function and the value of the law.Legal efficacy is the condition of the legal effect,but legal effect is the source of the legal enforcement.And legal efficacy emphasizes the state of affairs,while legal enforcement stresses the operating procedure.Legal efficacy manifests the 'unit',and legal enforcement includes the 'section',while legal realization is the organic combination of the 'unit'and the 'section'.
