Some Views of the Characteristics of Ostenible Agent and Its Requirements

针对目前关于表见代理定性的两种学术观点 ,指出表见代理是介于《民法通则》中有权代理和无权代理之间的一种新型代理制度 ,详细分析了表见代理的构成要件 ,从而为认定表见代理的性质 ,保护善意第三人利益 ,维护正常的经济秩序 。

With regard to two different kinds of scholastic views for determining the nature of apparent/ostenible agent,the ostenible agent is a new kind of agent system and between authorized agent and nullity agent in General Rule of The Civil Law . Analyzing ostenible agent requirement in detail and determining the characters of ostenible agent, the thesis provides the theoretical foundation for protecting profits of the third party and keeping the normal economical order and making the fair competition market.
