收容教育违法性研究

Research on Illegal Nature of Collecting Education

完善收容教育机制 ,是打击卖淫嫖娼行为 ,净化社会风气的重要保障。通过与劳动教养、收容教育、刑事处罚的比较研究 ,看出收容教育存在以下问题 :(1)定性不准 ;(2 )行政立法侵权 ,缺陷较多 ;(3)救济机制不畅 ;(4)监督制约不力 ;(5 )自由裁量权过大 ,人身自由难以保障。针对这些问题 ,借鉴社会防卫思想 。

Perfect collecting education rules are important safeguards in striking prostitution acts and in purifying general social moods. By means of contrast researches with labour breeding, collecting breeding and criminal sanction, we find following problems in collecting education:(1)Determining the nature isn't precise; (2)Administrative legislation invades rights and have shortcomings; (3)Relief mechanism isn't smooth; (4)Supervision and restriction aren't powerful; (5)Freely ruling are too powerful to ensure personal freedom. To counter these problems and to draw lessons from society defending thoughts, the paper puts forward some legislation suggestions.
