“互联网+”带来的知识产权新问题及解决对策

New Intellectual Property Issues Caused by “Internet plus” and Countermeasures

"互联网+"作为一个新概念,越来越受到人们的关注,但它在给人们的生活以巨大转变的同时,也出现了很多新的问题。例如,网络安全问题,传统行业管理模式与互联网+新模式不适应问题等等,而具体到知识产权领域,也出现出许多新的问题,需要我们进一步关注。以唯物辩证法的研究方法对互联网+带来的新的知识产权问题进行了研究,主要涉及几个方面:对专利法保护客体的冲击;对审查的冲击;对司法实践的冲击;对知识产权服务业的冲击。并提出了解决对策。

There is growing concern about the new concept'internet plus';however,internet plus not only makes a tremendous difference in people’s life,but also brings many new problems,e.g.network security problem,adaptability problem between the traditional industry management mode and new internet plus mode;many new problems also occur in intellectual property field,which requires more concerns.The article performs research on new intellectual property problems brought by internet plus by means of materialistic dialectic,and mainly on the following aspects:the impact on subject matter that can be protected by patent law;the impact on examination;the impact on legal practice;the impact on intellectual property service industry.Finally,countermeasures for solving the problems are put forward.
