摘要
现行民法的价值体系是由自由、平等和公平组成的。网络环境的开放性(无国界性)、交互性特征为民法自由价值的实现提供了一个更加广阔的空间;网络环境的开放性、虚拟性特征使安全和效率成为民法的重要价值目标;网络环境的数字化、技术性特征扩大了现行民法中平等价值的内涵;网络环境对公平价值的影响很小。因此,网络环境民法主要追求自由、平等、公平、安全、效率等价值理念。
The value system of present civil law comprises freedom,equality and fairness.Cyberspace offers a vaster space for realization of freedom due to its opening and mutuality;satety and efficiency become inportant values of civil law because of its opening and virtuality;its technicality and digitalization extend the conntation of equality of existing civil law;however,the influence of cyberspace on the present value of fairness is insignificant.Therefore,the valur system of civil law in cyberspace shall mainly include freedom,equality,fairness,safety and efficiency.
