摘要
中国不必制定民法典,而应立足中国现有的法律体系,制定民商法律总纲,并以此为指导完善现有的民商事单行法律,从而建立以民商法律总纲为统帅、以各单行法为骨干的民商法律网络。
The authors hold that codification is not the best way to modernize the chinese civil law, for the form of code in itself has some deficiencies. They insist on enacting the principles of civil and commercial law, on the basis of the existing system of chinese civil law, so as to improve all the civil and commercial laws, and then contruct the whole network of the civil and commercial law.
