摘要
修正后的《中华人民共和国农村土地承包法》已然明定土地经营权的可融资属性并授权国务院有关部门出台下位立法。迥异于一般市场融资和土地产权流转,土地经营权融资不仅含蕴公私双重属性,且面临土地用途和金融的双重管制。后续在土地经营权融资实体与程序规则制定过程中,必须系统研判考量管制与市场在这一领域的作用及边界,通过法律制度创新和供给,守住耕地红线不突破、农民利益不受损的底线,同时有效发挥土地资源的财产功能,防范和化解农地金融多元风险。
The rural land contracting law has already clarified the financing attributes of the land management rights.At the same time,it authorized the relevant departments of the State Council could to issue specific provisions.As we all know,land management rights financing contains the dual attributes of public and private.Besides,it is different from general market financing and land property rights transfer,due to subjecting to dual regulations of land use and finance.The roles and boundaries of the regulation and the market should be systematically considered in the process of formulating land management rights financing entities and procedures.The legal system innovation and supply not only could help us to keep the quantity of cultivated land and protect farmers’interests,but also could develop land resources property features and prevent the multiple risks of agricultural land finance.
