摘要
2011年以来,刑事立法对刑罚结构做了适度调整,2016年最高人民法院通过司法解释大幅压缩减刑规模,两者叠加导致监禁刑总体明显趋重。监狱实践表明,长期监禁刑实际服刑期限延长,监狱老龄化现象日渐凸显。监狱因应刑罚结构调整的变化,一方面应充分发挥减刑假释制度的功能,另一方面应加速推进监狱管理科学化、社会化、人道化。
Since 2011,the criminal legislation has made a moderate adjustment to the structure of the penalty.In 2016,the Supreme People’s court drastically reduced the scale of commutation through judicial interpretation.These two kinds of changes are combined to cause prison sentence obviously heavier.The statistics of prison indicates that the actual term of imprisonment for long term imprisonment has been extended and the aging phenomenon of prison is becoming more and more prominent.Prison office should adapt to the changes in the adjustment of the structure of penalty.On one hand,we should give full play to the function of the system of commutation and parole;on the other hand,we should accelerate the scientific,socialized and humanized prison management.
