搜索引擎自动补全功能有助于公民互联网搜索的便利,但是也有可能侵犯他人的隐私权和人格尊严等基本权利。既有的民事基本法律、特别法律和行业规范对这一点关注不足,导致对相关权利的保障存在重大缺陷。在现有法规不完善的情况下,我国应当通过全国人大常委会解释人权和人格尊严条款,实现基本权利在侵权处理上的间接效用。长远来看,我国应当明确规定隐私权和法人对某些基本权利的享有,民事基本法律和特别法律也应当在这一精神的指引下完善搜索服务提供者的事前审查和事后赔偿责任,并构筑法律体系内部的良性互动,以期对公民权利的全面维护。

The search engine auto-complete function is of great convenience;while it may violate the right to privacy or dignity.Established civil laws and industry norms shed little concern on this issue,resulting in these right being infringed.Under such condition,Standing Committee of the National People’s Congress may well interpret the human right and human dignity doctrines,making fundamental rights indirectly applying to civil conflicts.For the long term,the right to privacy and legal person’s fundamental rights should be confirmed,search engine suppliers’responsibility to check in advance and compensate afterwards ought to be constructed,and an effective interaction within the legal system is better to be built.
