摘要
我国在规制行政垄断方面存在'威慑不足'的缺失,为实现'最优威慑'目标,不宜继续加大对行政主体的制裁力度,而应加强对行政垄断受益经营者的制裁。在制裁行政垄断受益经营者方面,存在着两种范式,我国应实现从'另轨'范式向'有限并轨'范式的转变。行政垄断受益经营者可分为四种类型,在制定制裁规则时,应针对不同的类型合理地适用不同的制裁方式和制裁力度。反垄断法应为行政垄断受益经营者保留合理的抗辩空间,以平衡相互冲突的多种公共利益。
There is'a lack of deterrence'in the regulation of administrative monopoly in our country,in order to achieve the goal of'optimal deterrence',we should not continue to increase the intensity of sanctions on administrative subjects,but strengthen the sanctions on the beneficial operators of administrative monopoly.There are two paradigms to impose sanctions on the beneficial operators of administrative monopoly,our country should realize the transformation from'respective track'paradigm to'limited merging track'paradigm.The beneficial operators of administrative monopoly can be divided into four types,different sanctions methods and sanctions intensity should be reasonably applied according to different types when formulating sanctions rules.Antitrust law should reserve reasonable defense space for beneficial operators of administrative monopoly in order to balance various conflicting public interests.
