社会责任区分理论视域下互联网企业社会责任的私法规制 被引量:18

Private Regulation of Internet Corporate Social Responsibility in Perspective of Social Responsibility Differentiation Theory

摘要 相对于其他类型的企业来说,互联网企业因其技术的专业性、市场占有的垄断性、信息传播的迅速性、辐射主体的全面性、社会影响的广泛性和潜移默化性,有必要对其社会责任的承担提出完全有别于他类企业的特殊要求。我国现行'企业社会责任'私法规制不足,根据企业社会责任区分理论,探讨了互联网企业社会责任的私法规制路径与立法指导原则,创造性地将互联网企业的社会责任区分为一般性企业社会责任与特殊性企业社会责任,并对这两种社会责任的内容做出了全新的设计。 Compared with other types of enterprises,Internet companies are characterized by their professionalism,market monopoly,rapid information dissemination,comprehensiveness(popularity)of radiation subjects,extensive and imperceptible social influences.It is necessary to make a commitment to its social responsibility that is completely different from the special requirements of ordinary enterprises.This paper summarizes the basis of the current'corporate social responsibility'private law system in China.Based on the theory of corporate social responsibility differentiation,this paper discusses the private legal system path and legislative guiding principles of Internet corporate social responsibility,and creatively proposes the society of Internet enterprises.Responsibilities are divided into general corporate social responsibility and specific corporate social responsibility,and a new system for the content of these two social responsibilities is designed.
