互联网监管的“道路之争”及其规则意蕴

"Road Debates" of Internet Regulation and Its Rule Implications

互联网监管历来是一个在理论上和实践上都争议颇多的问题。尽管开展互联网监管已成为各国普遍实践,但西方国家出于维持网络霸权的需要,大力推行'互联网自由'战略,对中国等非西方国家的互联网监管政策加以指责和打压。不过,随着网络空间安全威胁的进一步扩散,近年来各国在互联网监管领域的若干实践呈加快趋同之势。法国总统马克龙在2018年11月互联网治理论坛上关于互联网监管'第三条道路'的演讲,就承认互联网监管的重要性和不同道路选择而言有着积极的意义。在此基础上,国际社会有可能就互联网监管的若干问题(如打击网络恐怖主义、社交媒体国际治理)达成某些共同的国际规则。包括中国在内的各国在互联网监管领域包容互鉴、互相学习,将为网络空间国际治理的深入推进提供重要契机。

Internet regulation has long been a controversial issue in theory and reality.While conducting internet regulation in different ways has become the general practice of most countries,the western powers,out of the desire to maintain their hegemony in the cyber domain,tend to criticize the internet regulation policies of China and other non-western countries based on the so-called'internet freedom'strategy.Yet with the proliferation of security threats in cyberspace,recent years have witnessed the increasing convergence of the national practices in the field of internet regulation.Against this background,the speech given by French President Macron during the World Internet Forum in November 2018 regarding'the third path'for internet regulation is a positive sign in terms of recognizing the importance of internet regulation and possibility of choosing different paths.Based on the above development,it’s possible for the international community to reach certain rules regarding various issues on internet regulation,e.g.fighting cyber terrorism.International cooperation among States based on the spirit of inclusiveness and mutual learning will present an important opportunity for improving international governance in cyberspace.
