New Development Concepts:The Strategic Guidance on China's Modernization of the Rule of Law

创新、协调、绿色、开放、共享的新发展理念,鲜明体现了当代中国共产党人对新的历史条件下中国社会发展规律的崭新认识,深刻表达了当代中国法治现代化进程的内在逻辑。以人民为中心的发展思想,是新发展理念的本体论根据,彰显着历史唯物主义法哲学的理论品格,构成了当代中国法治发展的基本准则。运用法治思维和法治方式践行新发展理念,必须紧密联系中国特色社会主义法治建设的实际,着力创设催生创新发展的法治基础,建构推动协调发展的法治机制,健全保障绿色发展的法治体制,塑造推动开放发展的法治格局,弘扬实现共享发展的法治价值。因之,我们要在新发展理念的战略引领下,统揽当代中国法治现代化进程的战略全局和时代走向,深刻把握这一革命性进程的环境条件、功能定位、价值取向和总体格局,坚定地走出一条具有鲜明中国特质的自主型的法治现代化之路。

The new development concepts:innovation,coordination,green development,opening up and sharing,clearly show that the Communist Party of China (CPC) has achieved a new understanding of China's social development under the new historical conditions,and profoundly express the inherent logic followed by the modernization of the rule of law in contemporary China. The development idea of peoplecenteredness is the ontological basis for the new development concepts,and it manifests the theoretical character of the philosophy of historical materialism and constitutes the basic criterion for the development of the rule of law in contemporary China. To implementing the new development concepts by following the idea of and approach to the rule of law,we should link the concepts closely with the construction of socialist rule of law with Chinese characteristics,focus on consolidating the legal foundation for innovative development,construct the legal mechanism to promote the coordinated development,perfect the legal system of protecting green development,shape the legal environment for advancing open development,and enhance the value of the rule of law to achieve shared development. Therefore,under the strategic guidance of the new development concepts,we have to master the overall strategy for and the trend in China's modernization of the rule of law,grasp its condition,function,value-orientation and the overall pattern,and resolutely open up an autonomous development road with distinctive Chinese characteristics to the modernization of the rule of law.
