Formation of the Spirit of the Rule of Law:Viewed from Six Perspectives

法治精神的培育是全面深入推进依法治国战略中重大而迫切的任务,法治精神的形成至少有本体、动力、对象、路线、结构、方法等六个关键要素。法治精神的本质意涵是法治思想的启蒙;法治精神培育的强大动力是法学学派的形成;法治核心目标是规范公权力运行,因此领导干部应当是法治思维培育的核心对象;法治精神培育应当坚持群众路线,保障人民参与权;法治社会应当权力下移,法治精神的培育也应重视社会组织的作用;法治精神培育的主要方法是精神教化,因此应当将法治纳入国民教育。

The cultivation of the spirit of the rule of law is a major and urgent task in comprehensively advancing the rule of law in China. The formation of the spirit of the rule of law involves at least six key elements,namely ontology,driving force,goal,route,structure and method. The essence of the spirit of the rule of law is the enlightenment and emancipation enabled by the thoughts on the rule of law. The strong impetus to cultivate the spirit of the rule of law comes from the formation of schools of law. The core goal of the rule of law is to oversee the operation of public power,so leaders should be the core object of the cultivation of the spirit of the rule of law. Cultivating the spirit of the rule of law should adhere to the mass line and protect people's participation rights. The power in a society governed by the rule of law should be distributed to the lower levels of the social hierarchy and enough attention should be paid to the roles played by different social organizations in cultivating the spirit of the rule of law. The method of cultivating the spirit of the rule of law is education,which constitutes an indispensable part of general education.
