摘要
《各行其是——法学界与法院》一书是波斯纳审视美国司法制度的第三本著作。书中认为,司法界与法学界的"各行其是"是导致美国当今司法实践困境的重要成因。尽管此书中的种种建议甚至未必能解决美国的问题,因此更不可能有效回应中国的问题,但此书提出的问题,以及波斯纳切入问题的视角和展开的分析还是应当引发中国法学人的关注。对于当下的司法改革研究者和实践者来说,尤其应当适度地调整知识需求和储备,将司法过程中的实践经验纳入一种社会科学的系统思考和分析,以此才可能改善中国的司法,促进和拓展中国的法学。
Posner's Divergent Paths:The Academy and the Judiciary is the third book of his reflection on the US judicial system. The proposals he advanced in this book may not be able to solve the problems in the United States,and thus it is less likely to effectively address China's problems. However,the issues,the perspectives and the analyses put forward by the author should concern Chinese scholars. As for those who are,in theory or in practice,engaged in the judicial reform in today's China,the implications they can draw from Posner's book are that they can in particular adjust their knowledge demand and storage,and give the experience gained in the judicial practice a systematic reflection and analysis within the framework of social sciences. Only by so doing can they improve China's judicial system and promote the development of Chinese legal science.
