Relationship between Criminal Legal Dogmatics and Integrative Criminal Justice

刑法教义学和刑事一体化都是现代刑法学的重大前沿理论问题。刑法教义学维护了刑法的安定性和精确性,有利于人权保障的实现。但教义学缺乏分析的语境主义观照,容易形成理论逻辑与实践逻辑的脱节。刑事一体化强调客观情势与问题导向,从教义学以外的视角观察和解决刑法问题。作为研究方法,刑法教义学与刑事一体化并非互不相扰,二者应该关联而互补。刑法学的研究既要重视教义学的发展与完善,也要从一体化的角度解读刑法规范和相关概念,在事物的相互联系中发现刑法概念的真正本质,并在相互关联中穿透和解答网络时代、风险社会等现实语境给刑法带来的深刻变化。

Criminal legal dogmatics and integrative criminal justice are both the critical issue in the area of modern criminal law studies.Criminal legal dogmatics maintains the stability and accuracy of the criminal law and helps guarantee human rights.However,the criminal legal dogmatics pays little attention to the context for legal analysis,leading to the separation between the theory and the practice in logic.On the contrary,the theory of integrative criminal justice emphasizes the objective situation and is problem-oriented,favoring the perspective other than legal dogmatics for examining and solving criminal issues.As two research methods,criminal legal dogmatics and integrative criminal justice are complementary to each other rather than being mutually exclusive.In this sense,the research on criminal justice should pay equal emphasis to the development and perfection of criminal legal dogmatics and the interpretation of the criminal law and the related concepts from the perspective of integrative criminal justice.Thus from observing the interconnections between different issues,the real essence of criminal justice will be revealed and the profound changes in criminal justice,which are caused by such factors as the emergence of risk society and the Internet era,will be fully understood.
