Analyzing the Verdict of Innocence in the Retrial of Nie Shubin Case

基于"聂树斌案件"的裁判文书,本文指出冤罪产生的根本原因在于刑事司法轻视以审判为中心的原则而过于注重供述。与此同时,本文认为这一裁判文书判决要旨的法治意涵,在于关注证据的证明力,尤其是倡导证明标准的明确化。

Through analyzing the adjudicative documents of the Nie Shubin case, we argue that the cause for the original wrong judgment lies in the fact that the statement of guilt made by the defendant outweighed the principle of centering on courtroom hearings in the handling of Nie's case. As far as the rule of law is concerned, the significance of such documents is to require the judiciary to pay close attention to the probative force of evidence and in particular to promote the clarity of the proof standard.
