德日经济法理论演进及启示

On the Evolution and Inspiration of Germany and Janpanese Economic Law Theory

经济法理论研究是我国法学研究重要领域 ,在我国已成功加入世界贸易组织及社会主义市场经济继续深入的情况下 ,经济法理论研究亟需转型 ,应由一贯的功能论摆脱出来。考察德国和日本经济法理论学说之演变 ,无疑有助于这一进程。笔者通过德、日经济法理论学说之演进 ,说明当前经济法理论已趋于实务化 ,特别是德国的经济宪法和经济行政法角度对经济法研究 ,是十分值得我国借鉴和发展的。

The research of economic Law theory is an important field of our country's law research.Under the circumstances of our succeisfl entry into WTO and further development of our socialist market economy,the research of economic law theory badly needs changing its way and should be freed from its original function theory.Examining the evolution of Germany and Japanese economic law theory undoubtedly helps the proceedure.Forcusing on the evolution the Germany and Japanese economic law theory,the author draws such a conclusion that the present economic law theory has tended to physics and especially the Germay research in this fileds is worth borrowing and developing.
