摘要
外观上正义作为国家治理的根本性立场,即国家不为某一群体私利之器而专职公平正义的立场,已然成为普遍共识。在此立场下,行政区划单元内的区域治理,以及基于区域代表和利益代表的代议制治理,在现代社会人员跨区域频繁流动的背景下,便凸显了外观正义上的风险及问题。我国在法院改革中实施的异地管辖举措,包括"互换式"管辖、"推磨式"管辖以及集中管辖等方式,表明我国通过司法改革不断推进外观上正义的努力。作为这一改革方向的延续,跨行政区划法院的设立有望更好地承接相关改革意愿,并继续深化相关改革进程,以切实推进"外观上正义"改革目标的实现。
As a fundamental position of state governance, that is, the one of state emphasizing fairness and justice without considering the private benefit of certain group, the appearance justice has become a general consensus. From this standpoint, the regional governance in the administrative division units and representative governance based on the representation of region and interest highlight the risks and problems in the appearance justice under the background of frequent cross-regional personnel mobility in the modern society. The jurisdiction measures of different places implemented in court reform in China, including "interchangeable", "push-and-grind" and centralized jurisdiction, show that our country is constantly promoting the appearance justice through judicial reform. As the continuation of this reform orientation, the establishment of crossing administrative division court is expected to undertake the relevant reform will better and continue to deepen the relevant reform process so as to push forward the realization of ultimate goal of "appearance justice" practically.
