停学惩戒的正当性及其对学生发展的影响

The Legitimacy of Suspension Punishment and Its Impact on Students’ Development

摘要 教育惩戒的合理限度带有很大的模糊性和可变性,正当性是能否采取停学手段惩戒学生不良行为的前提。法律虽未明确规定是否可以采取停学手段惩戒学生,但停学惩戒不但侵犯了学生的合法权益,也对学生的人格发展造成负面影响。在实践中,停学惩戒可以参考国外的做法加以矫正改进,并注意严格限制停学惩戒的适用范围和程序正当性。 The reasonable limit of educational punishment has great fuzziness and variability,and legitimacy is the premise of punishing students'bad behavior by means of suspension.Although the law does not specify whether suspension punishment can be adopted,suspension punishment not only infringes on students'legitimate rights and interests,but also has a negative impact on students'personality development.In practice,suspension punishment can be corrected and improved by referring to foreign practices,and attention should be paid to strictly restricting the scope of application and procedural legitimacy of suspension punishment.
