论近二十年来中国经济法学研究方法之流变

On the Evolution of Research Methods in China’s Economic Law in the Past Two Decades

近二十年来,中国经济法学的研究方法呈现出多元化的发展态势,既采用价值分析方法构建基本规则,也吸收经济学、社会学、政治学等社会科学研究方法增强理论与实践间的联系。随着理论研究的深入,有学者逐渐注意到多元研究方法带来的割裂和断层,主张回归法教义学、法哲学等法内研究方法夯实理论基础,并通过实证分析方法予以证实。从本质上讲,经济法学是一门以问题为导向的社科法学,因此在研究经济法学时,应以创新社会科学研究方法为主,以强化法教义学研究方法为辅来提升经济法学理论的解释力,应对日益复杂的经济法律现象,促进经济法学理论体系的成熟与完善。

In the past two decades,the Research Methods of Economic Law have shown a trend of diversification.Scholars use Value Analysis Methods to set basic rules,and also absorb Social Science Research Methods such as economics,sociology,and political science to increase the connection between theory and practice.With the deepening of theoretical research,some scholars have gradually noticed the fragmentation and fault brought about by the multiple Research Methods.These scholars have proposed to the regression of in-law Research Methods such as Methodology of Jurisprudence and Legal Philosophy Research Method to consolidate the theoretical foundation and then to confirm it through Empirical Analysis Methods.However,in essence,Economic Law is a kind of problem-oriented social science law.Therefore,in order to increase the explanatory power of the theory of Economic Law to cope with increasingly complex Economic Law Phenomenon and promote the maturity and perfection of Economic Law Theory System,the Research on Economic Law should still be based on innovating Social Science Research Methods,and improving Methodology of jurisprudence at the same time.
