人是一种性存在,性是每个人的本质组成部分。性尊严是作为性存在的人所固有的尊严,构成作为人权的性权利之基础,包括性器官尊严、性意志尊严、性行为尊严和性关系尊严。性尊严要求规制人类之性的性法律,对性采取一种肯定的态度,废除各类性的污名,尊重、保护个人的性权利,惩治践踏性尊严的违法犯罪行为。人类性法律的发展,诸如强奸法的扩张、性骚扰法的出现以及鸡奸法的废除等,符合性尊严的要求,昭示着社会的进步。

Human beings are sexual beings,and sexuality is an essential part of every person.Sexual dignity includes the dignity in one’s sexual organs,sexual will,sexual act and sexual relationship.It is the inherent dignity of every human being as sexual being and constitutes the foundation for sexual rights as human rights.Sexual dignity requires sex laws,which regulate human sexuality,to adopt a positive attitude to human sexuality,to abolish stigma of sexuality,respect and protect individual’s sexual rights,and to punish offences of trampling on one’s sexual dignity.The developments of sex laws such as the expansion of rape law,the emergence of sexual harassment law and the abolishment of sodomy law have met the requirement of sexual dignity and shown social progress.
