民法学之权利意志论的应用价值研究

Research on the Application Value of the Will of Rights in Civil Law

权利观是任何法律思维的重要构思,构成了解析民法学运用十分重要的观点,而基于权力观自身具有着较强的防御性、普遍性、主体性等特点,对权力意志论的研究能够帮助我们更好的对其中一些抽象性概念内容做出全面而深入的理解,使得其在民法学中具有着广泛的应用性。为此,关于民法学的研习与探究应当能够全面关注权利意志论的重要应用价值,从权力观的特点出发多角度呈现权力意志论的社会契约精神,据此达到灵活运用民法理论以及增强民法思维的目标。首先,文章就权力意志论的基本内涵、特征等内容进行了全面的介绍;其次,围绕在民法学领域运用权利意志论的重要价值进行了探究;最后,从契约自由、物权行为、国家干预三个不同的方面对民法学权利意志论的具体的运用要点做出了详细的介绍。

The concept of rights is important in any legal thinking,which is a very important viewpoint to analyze the application of civil law.However,because of its strong defensiveness,universality,subjectivity and other characteristics,the concept of power has a wide range of applications in civil law,the study of the theory of will to power can help us better understand some abstract concept which contains more abstract concepts.Therefore,the study and exploration of civil law can help us pay full attention to the important application value of the theory of will to power and cultivate the social contract spirit.Accordingly,it achieves the goal of flexible application of civil law theory and strengthening the thinking of civil law.Firstly,this paper gives a comprehensive introduction to the basic connotation and characteristics of the theory of will to power;secondly,it explores the significance of applying the theory of will to power to civil law;finally,it makes a detailed introduction to the concrete applications of the theory of will to right in civil law from in the following three different aspects:freedom of contract,act of real right and state intervention.
