论《物权法》中登记对抗主义

On Registration Confrontation Doctrine in Property Law

《物权法》以定分止争为目标阐述有关物权的基本原则。特殊动产登记对抗主义是我国《物权法》中规定的物权变动规则。由于登记对抗主义在我国法律体系中的特殊性,使得特殊动产物权变动在生效要件、登记的法律效力、善意第三人的性质和范围方面还存在分歧。消除《物权法》中登记对抗主义的分歧,应完善登记对抗制度内容:重视登记对抗的应用价值;推动立法技术成熟。

The Property Law elaborates basic principles of property with the goal of resolving disputes.The registration confrontation doctrine of special movable property is the rule of property variation stimulated in China’s Property Law.Due to the particularity of registration confrontation in China’s legal system,there are still differences in the property variation of special movable property in terms of validity requirements,legal effect of registration,nature and scope of bona fide third party.In order to eliminate the differences of registration confrontation in Property Law,it is necessary to improve the content of registration confrontation system,attach importance to the application value of registration confrontation,and promote the maturity of legislative technology.
