On the Obligation Dimension of the Construction of Legal Culture

既有的法文化建设倾向于权利本位,忽略了权利之保障以义务之履行为前提。基于三人社会模式和文明转型概念,反省当代社会规避法律、违反法律的原因,区分法治文化的本土资源和礼治文化的本土资源,可从历史和逻辑两个方面,阐述义务作为法治文化和礼治文化最大公约数的学理依据,提出迈向善治文化的价值目标和价值内容。

The existing construction of legal culture tends to be rights-based and ignores the premise that the protec?tion of rights is based on the fulfillment of obligations.Through the application of the three-person social model and the con?cept of civilization transformation,this paper reflects on the reasons why the contemporary society evades and violates the law,distinguishes the local resources of the rule of law culture from the local resources of the ethic culture,demonstrates that the obligation is the theoretical basis for the greatest common divisor of the rule of law culture and the ethic culture from both the historical and logical aspects,and puts forward the value goal and the value content towards the good governance culture.
