所有权问题是社会主义市场经济中的基础法律问题,对所有权的准确理解有助于民营经济所有权在中国当前社会阶段的定位和保护。鉴于前一段时间有关否定民营经济的观点,有必要在理论上进一步厘清民营经济所有权涉及的主要问题,从而为保护民营经济所有权提供理论支持。有必要先从民法的视角展开观察,再从民营经济所有权所具备的重要政治、经济意义以及其对民生的重要影响等方面来深化对它的认识。事实上,所有权观念的历史演进以及有关民营经济所有权保护的历史表明,承认民营经济所有权的法律地位并给予其充分的保护,是社会经济健康发展不可或缺的支撑。

The issue of ownership is the basic legal issue in the socialist market economy.The accurate understanding of the ownership issue will help positioning and protecting the private economy ownership in modern Chinese society.In view of the fact that the private economy has been denounced for a while,it is necessary to further clarify the main problems involved private economy in theory,to provide theoretical support for protecting the ownership of the private economy.In this regard,we can firstly observe the ownership of the private economy from the perspective of civil law,and deepen its understanding from the perspectives of its important political and economic significance and its important influence on people's livelihood.In fact,the historical evolution of the idea of ownership,and the history related to protection of private economic ownership,show that recognizing the legal status of private economic ownership and giving it full protection are indispensable support for the healthy development of economy and society.
