本文以生活美容机构未取得《医疗机构执业许可证》开展医疗美容活动为例,从案件查办实务出发,深入探讨该类型卫生行政处罚案件的查办思路和办案逻辑,系统化展现案件查办过程中办案人员在事实印证、证据收集、主体认定、法律适用、办案程序、处罚裁量等方面的具体思路和应予注意的关键点,以期从案件查办类型化的视角,为该类型案件查办提供规范化指引。

Taking the medical cosmetology activities carried out by the life cosmetology institutes without obtaining the"Practice License of Medical Institutions"as an example,starting from the practice of case investigation,this paper probes deeply into the thinking and logic of case investigation of this type of health administrative penalty cases,systemati?cally demonstrates the fact verification,evidence collection,subject identification,legal application,case handling proce?dure and penalty discretion of the case handlers in the process of case investigation.Attention should be paid to specific ideas and key points in order to provide standardized guidance for the investigation of this type of cases from the perspec?tive of typification.
