“条块互嵌”和基层治理法治化——县域治理创新的角度

“Embedded Strip-Block Relationship” and Legalization of Grass-Roots Governance——A Perspective of County Governance Innovation

县域治理创新是基层治理法治化的重要保障。华北某县盗采治理过程表明,基层治理困境的重要表现之一是法治不彰,其主要原因是县域政权的条块分割导致执法碎片化、执法效率低下。县域体制变革使数量巨大的、分散在各个部门的执法权力能够整合起来形成“条块互嵌”的行政权力网络。它包括联合执法、建立“三协同”综合执法链及权力清单制度三方面的内容。成功推进这一县域治理创新须遵循五方面的逻辑和条件:党建引领是基本动力;法治思维是基本特征;有效治理是基本目标;赋权街乡是基本路径;渐进改革是基本策略。这启发地方通过县域治理的整体性变革来推动基层治理的法治化,形成基层行政权力网络。

Innovation of county governance is an important guarantee for the legalization of grass-roots governance.Based on the process of illegal mining management in a county in North China,it is found that one of the important manifestations of grassroots governance dilemma is the lack of rule of law,which is mainly due to fragmentation of law enforcement and inefficiency of law enforcement caused by fragmentation of county regime.Through the county system reform,it is the key to integrate the huge number of law enforcement powers scattered in various departments to form a“embedded strip-block relationship”administrative power network.It includes three aspects:joint law enforcement,the establishment of a three-coordinated comprehensive law enforcement chain and the power list system.Successful promotion of this county governance innovation needs to follow five aspects of logic and conditions:party building is the basic driving force,rule of law thinking is the basic feature,effective governance is the basic goal,empowerment of the streets and townships is the basic path,and gradual reform is the basic strategy.This enlightens the local government to promote the legalization of grassroots governance through the overall reform of county governance,and form the grassroots administrative power network.
