规范性文件司法审查标准的重构

由于理念和方法的不足,实践中规范性文件司法审查标准过于随意和分散、缺少主线和核心,一定程度上导致裁判尺度不一甚至结果相悖,未能很好地实现附带审查制度设计的初衷。有必要在创新性与可操作性并重的前提下,为规范性文件附带审查重构一套复合性审查标准体系。在实质合法理念下宜采用合法(律)性为主、合理性为辅的审查原则,分步骤进行,明确对原则之下不同的审查角度进行分层次审查,并区分审查原则和角度确定不同的审查标准。

Due to the lack of theory and methodology, the standards for judicial review of normative documents in practice is too arbitrary and disorderly, without a thread running through and a focus. To some extent, different standards for judicial review lead to different judicial decisions and even contradictory results, and therefore the original intention of incidental review system is not well realized. It is necessary to reconstruct a system of complex review standards for normative documents under the premise of innovation and operability. Guided by the concept of substantive legality, it is advisable to adopt the "legality-based and rationality-supplemented" principle to carry out the examination step by step. Different examination angles under the principle should be examined at different levels, and different examination standards should be determined according to different examination principles and angles.
