侦查人员认知偏差的矫正原则与策略研究

A Research on Correction Principles and Strategies of Investigators’ Cognitive Deviation

侦查人员认知偏差是侦查错误乃至侦查错案发生的深层次心理原因,有针对性地矫正侦查人员认知偏差具有重要的理论意义和实践价值。从侦查人员认知偏差的基本特点、产生原因和作用机制出发,有针对性地矫正侦查人员认知偏差是可能的。矫正侦查人员认知偏差应当坚持针对性原则、时效性原则、预防性原则和控制性原则。侦查人员认知偏差的矫正策略主要包括基于侦查人员心理与行为的矫正策略、基于侦查机关组织环境与文化氛围的矫正策略和基于方法工具的矫正策略三个方面。

Investigators’cognitive deviation is the deep-rooted psychological cause of investigation errors and even the occurrence of wrong cases,so targeted correction of cognitive deviation of investigators has important theoretical significance and practical value.It is possible to correct cognitive deviation of investigators in a targted way,starting from the basic characteristics,causes and action mechanism of investigators’cognitive deviation.We should stick to principles of targetedness,timeliness,prevention and control.The correction strategies of investigators’cognitive deviation mainly include three aspects:correction strategy based on psychology and behavior of investigators,correction strategy based on organizational environment and cultural atmosphere of investigation organs,as well as correction strategy based on methods and tools.
