摘要
自1996年颁布《行政处罚法》以来,规章是否存在行政处罚设定权一直饱受争议。特别是2015年《立法法》修改后,对规章行政处罚设定权正当性的质疑更加强烈,这主要是因为它与《立法法》规定的规章仅有执行性立法权限相冲突。相比规章行政处罚设定存在论,废除规章的行政处罚设定权具有宪法、立法法及行政立法上的正当性。基于法制统一和行政管理的现实需要,应当全面取消部门规章的行政处罚设定权;对地方政府规章而言,全国人大和国务院可以授权地方政府设定部分行政处罚。
Since the promulgation of the Administrative Punishment Law in 1996,whether the regulations have the right to set administrative penalties has been controversial.In particular,after the revision of the"Legislation Law"in 2015,the questioning of the legitimacy of the administrative punishment of administrative regulations was even more intense,mainly because it conflicted with the enforcement of legislative powers under the provisions of the Legislative Law.Compared with the establishment of the administrative punishment of the regulations,the abolition of the administrative penalty setting authority has the legitimacy of the constitution,the legislative law and the administrative legislation.Based on the actual needs of the legal system and administrative management,the administrative punishment setting authority of departmental regulations should be completely abolished.For local government regulations,the National People's Congress and the State Council may authorize local governments to set some administrative penalties.
