摘要 城市立体化开发已成为当前土地利用的重要趋势,传统的二维空间权利体系难以满足地表、地下、地上不动产权属不同的登记需要。本文通过研究既有法律法规及相关政策,同时参考其他城市的不动产立体空间登记方法,创新提出三维空间下的不动产空间权利体系,并在此基础上研究不同竖向利用层次、空间实体形态、建造方式的不动产实体三维空间权利界址确定与登记方法。本文所提出方法已应用于广州不动产登记的实际工作中,具有操作可行性。 Three-dimensional urban development has become an important trend in land use,the traditional two-dimensional space rights system is difficult to meet the different registration needs in land surface,underground and above-ground.By studying the existing laws and regulations,referring to the three-dimensional space registration methods of real estate in other cities,this paper innovatively proposes real estate spatial rights system in three-dimensional space and confirmation method of real estate rights boundary with different vertical levels,spatial forms and construction way.The method proposed in this paper has been applied to real estate registration in Guangzhou and proved to be feasible.
