专利法第二十二条第三款规定:授予专利权的发明和实用新型应当具备新颖性、创造性和实用性。创造性是发明被授予专利权的必要条件之一。文章从创造性的概念出发,对权利要求中技术方案的理解方式进行了全面的解读,同时,为了帮助判断,从发明构思、最接近现有技术的技术教导、其他现有技术的结合启示等多个方面分析了创造性判断过程中技术方案的整体把握原则。

Article 22(3)of the Patent Law stipulates that inventions and utility models for which patent rights are granted shall be novel,creative and practical.Creativity is one of the necessary conditions for invention to be patented.Starting from the concept of creativity,this paper makes a comprehensive interpretation of the understanding of the technical scheme in the claims,and at the same time,in order to help judge,this paper analyzes the overall grasp principles of the technical scheme in the process of creative judgment from many aspects,such as the invention conception,the technical teaching closest to the existing technology,the combination of other existing technologies and so on.
