论台湾地区涉外子女身份准据法中的公序良俗

On the Public Order and Good Custom in the Applicable Law of the Identity of Foreign-related Children in Taiwan

在跨国子女身份法律选择领域,台湾地区"涉外民事法律适用法"第八条之公序良俗条款发挥着特殊的保护功能:在跨国婚生子女身份准据法中,台湾地区将妻子和子女的婚生否认权作为公序良俗条款的保护对象。当外国法的适用结果限制妻子、子女平等的婚生否认权时,台湾地区将依据公秩良俗条款拒绝适用外国法,以实现夫妻两性地位平等和保护儿童利益最大化。其次,在跨国收养形成的拟制亲子身份法律选择领域,台湾地区将实现当事人权利的公平作为公序良俗之重要考量因素,以矫正跨国收养法律选择中的不平等。

In the field of choice of law about transnational children status,the public order and good customs clause of Article 8 of Applicable Law of Civil Law concerning Foreign Affairs in Taiwan Region plays a special protection role.First of all,in the applicable law of the status of legitimate children,Taiwan Region takes wife and children’s right of denying birth in wedlock as objects of protection of public order and good customs clause.When the application result of foreign law restricts the equal right of wife and children to deny birth in wedlock,Taiwan Region will refuse to apply foreign law according to the reservation of public order in order to realize the equality of husband and wife’s gender status and protect the best interests of children;Secondly,in the field of choice of law about the fictitious parentage formed by intercountry adoption,the realization of the fairness of the rights of the parties is regarded as an important consideration factor of public order in order to rectify the inequality in the application of the law of intercountry adoption.
