高校“本降专”规定的合法合理性审视——兼论高校校规合法性审查机制

On the Legitimacy and Rationality of the Provisions on the Undergraduate Students’ Downgrade to Junior College——On the Construction of Review Legitimacy Mechanism of University Regulations

高校"本降专"规定与《高校学生管理规定》部分条款相抵触,存在合法性与合理性瑕疵。有必要在尊重高校自主管理权和章程治理权的基础上,修改"上位法"相关条款或通过章程特别授权,此举既能促进高校制度探索与创新,又可保障教育法治的统一性和严肃性。此外,高校也应构建内部合法性审查机制,通过设立专门审查机构、配备专业法务人才、制定审查规则,以及保障民主参与监督等措施,保障校内"立法"质量,提升高校依法依章治理水平。

There are some defects of legitimacy and rationality in the Regulations of Undergraduate Students’ Downgrade to Junior College which are in conflict with some provisions of the Regulations of College Students Management.The author of this paper contends that it is necessary to modify the relevant superior provisions or the special authorization of the relevant university statutes on the basis of respecting the self-management power of the university and the governance rights of the relevant university statutes.This kind of practice cannot only promote the exploration and innovation of the university management system,but also guarantee the unity and seriousness of the education rule of law.In addition,colleges and universities should also establish an internal legitimacy review mechanism to ensure the quality of"legislation"within the university and establish the level of governance according to the law by such measures as setting up special review institutions,providing professional legal talents,formulating review rules,and safeguarding democratic participation supervision.
