行政法视角下未来我国商业体育赛事发展研究

Future Development of Commercial Sports Events in China from Perspective of Administrative Law

我国即将面临商业体育赛事管理方面的制度革新,而商业体育赛事管理的新型法案有助于社会资本进入体育赛事领域,对促进体育产业的发展会产生不可估量的作用。主要通过文献资料法收集关于行政法视角下完善我国商业体育赛事发展中所存在的一系列法律问题,使未来我国商业体育赛事的发展更加完善。研究认为,取消赛前行政审批环节是赛事管理制度改革的重中之重,且完善赛中、赛后的监管措施对体育赛事的健康可持续持发展至关重要。基于我国体育行业的实际情形,改革商业体育赛事管理法可以从体育赛事目录制度、体育行业组织治理结构、引导型行政措施和法律法规衔接性制度安排等方面逐一进行完善。

China will soon face the institutional innovation in commercial sports events management,and the new legislation on commercial sports events management will help social capital enter the field of sports events and play an immeasurable role in promoting the development of sport industry.In this study,literature review method will be used to collect a series of legal problems existing in the development of commercial sports events from the perspective of administrative law,so as to improve the development of commercial sports events in China in future.It is found that canceling pre-competition administrative approval is the top priority of event management system reform,and improving the regulation measures during and after competition is crucial to the healthy and sustainable development of sport events.Based on the actual situation of domestic sport industry,it can be known that the reform of commercial sports event management law can be improved gradually from directory system of sports events,organization and governance structure of sport industry,guiding administrative measures and institutional arrangements for cohesion of laws and regulations.
