卡—梅框架下我国排污权担保的规则配置研究

On the Configuration of China’s Emission Right Guarantee Rules under the C&M Framework

以环境容量权益为标的之排污权担保,既是排污权交易的重要形式,亦是绿色金融和非典型担保制度创新。然而,我国对于排污权担保的相关实践探索和理论研究尚处于初步阶段,排污权担保制度还存在一些困境。如何研究揭示这些问题,并对我国的排污权担保制度进行完善,是一个迫在眉睫的问题。传统的法律解释学从内部维护担保法律体系完整以捋平现实与规则之间的矛盾,分析问题和完善对策有一定的偶然性和随机性。卡—梅框架从法律效果出发,按照法益初始配置与公权介入程度不同,将法律规则抽象成不同类型,适用范围从“权利救济”拓展到“利益交换”,对排污权担保规则的配置具有指导意义。在对排污权担保规则进行类型化分析后可以发现,排污权担保中各类规则的宏观结构性配置和微观具体性配置都存在一些问题,为此,应从宏观配置和微观配置方面对这些规则进行系统性完善。

The guarantee of emission right based on environmental capacity is not only an important form of emission right trading,but also an innovation of green finance and atypical guarantee system.However,the practical exploration and theoretical research on the guarantee of emission right in China are still in the preliminary stage,and the guarantee system of emission right still has some difficulties. How to study and reveal these problems,and improve the emission right guarantee system in China,is an urgent problem. Traditional legal hermeneutics maintains the integrity of the guarantee legal system from the inside to straighten out the contradiction between reality and rules,while analyzing problems and improving countermeasures with certain contingency and randomness. Starting from the legal effect,the C&M framework abstracts the legal rules into different types according to the initial allocation of legal interests and the degree of public right involvement,and extends the scope of application from "right relief"to"benefit exchange",which has guiding significance for the allocation of the emission right guarantee rules.Based on the classification analysis of the emission right guarantee rules,it can be found that there are some problems in the macro structural allocation and micro specific allocation of all kinds of rules in the emission right guarantee. Therefore,these rules should be systematically improved from the aspects of macro and micro configuration.
