摘要
目前,政府数据开放内涵不清晰和范围不明确,在理论上易与相关概念混淆,在实践上影响政府数据开放工作的开展,需要在比较中把握政府数据开放的概念,并从应予开放、不予开放两个方面全面界定政府数据开放的范围。明确以开放为原则、以不开放为例外,以开放优先为原则、以保密前置为例外,以惠民便民为最高标准、以法益保障为最低红线等原则,充分考虑我国的国情,合理确定政府数据开放的实现路径和具体范围,分层界定政府数据不予开放的范围,厘清二者的界限,以推动政府数据开放的法治化步伐,优化政府数据开放质量,实现政府数据开放效能的最大化。
Concept is the basis of thinking and working.At present,the concept of government data openness and its scope are not clear.It is easy to confuse with related concepts in theory.This situation affects the development of government data openness in practice.It is necessary to grasp the essence of government data openness in comparison,and define it comprehensively from two aspects:openness and non-openness.We should clearly take openness as the principle,non-openness as the exception,openness first as the principle,confidentiality as the exception,people-friendly as the highest standard,legal interest protection as the lowest red line and other principles,fully consider China s national conditions,reasonably determine the path and specific scope of government data openness,and define government data at different levels.We need clarify the boundaries of openness and non-openness,and then promote the pace of the rule of law relating government data openness,optimize the quality of government data openness,and achieve the maximum efficiency of government data openness.
