当代中国私力救济的法理正当性探究

On Legal Legitimacy of Self-help Remedy in Contemporary China

私力救济在缓和社会矛盾、调节人与人之间的利益冲突中扮演着举足轻重的角色,但在人们的印象中往往与极端、暴力、落后相关联。从以下方面论证当代中国私力救济的法理正当性:自然法中人性基础之动物性、经济理性;历史法学派中中华民族私力救济的历史实践理性;中国传统社会的“一元道德化”合理性证成模式下对“和”的追求。

Self-help remedy plays a pivotal role in easing social conflicts and relieving the crisis of interests between people,but it is often associated with extremism,violence and backwardness in people’s impressions.This article explores the legal legitimacy of self-help remedy in contemporary China from the following aspects:the animal instinct and economic rationality of human nature in natural law;the historical practice rationality of Chinese private relief in historical law school;the pursuit of“Harmony”under the mode of the rationality model of“Monistic Moralization”in traditional Chinese society.
